KCC assesses $55,750 in fines against 43 motor carriers

The Kansas Corporation Commission (KCC) assessed $55,750 in fines and penalties against 43 motor carriers for violations of Commission rules and regulations during the first-quarter of the state’s fiscal year 2006 (July 1, 2005 - September 30, 2005). The violations were discovered during Safety Compliance Audits of 146 motor carriers, performed by the Commission’s Transportation Division.

The Commission fined:

  • Two Rivers Vending Co. Inc., Salina, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and for operating a commercial motor vehicle without a valid medical examiners certificate.
  • James N. Whittley d.b.a. Whittley Excavating Wellington, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program for each driver employed.
  • Agsun L.L.C., Brewster, Kans. $500 for failure to require a driver to prepare a record of duty status report.
  • Direct Supply Inc., Lenexa, Kans. $750 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate and operate a commercial motor vehicle without a periodic inspection.
  • Ward Feed Yard LLC, Larned, Kans. $3,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle in excess of the maximum gross weight allowed by law.
  • Old World Cabinet Inc., Linwood, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
  • Valley Offset Printing Inc., Valley Center, Kans. $1,500 for three safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate, to operate a commercial motor vehicle without a periodic inspection, and failure to maintain a current motor vehicle record for each driver employed.
  • Jan R. Schemper Trucking LLC, Prairie View, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and for failure to require a driver to prepare a record of duty status report.
  • Eileen Wilhite d.b.a. J & E Alfalfa, Larned, Kans. $5,000 for three safety violations. The violations include allowing or requiring a driver to make false entries in his record of duty status report, to operate a commercial motor vehicle in intrastate commerce without intrastate for-hire operating authority, and to operate a commercial motor vehicle in excess of the maximum gross weight allowed by law.
  • McNair Furniture Inc. d.b.a. Pittsburg Interiors, Pittsburg, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver employed and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Overland Tool Inc., Lenexa, Kans. $1,500 for two safety violations. The violations include failure to maintain driver qualification files for each driver employed and failure to require driver to prepare a record of duty status report.
  • RFB Trucking LLC, Pittsburg, Kans. $500 for failure to maintain a current motor vehicle record for each driver employed.
  • James M. Martin or Susan Martin d.b.a. Martin & Son Logging, Lucas, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program for each driver employed.
  • Country Feeds Co., Montezuma, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • La Superior Foods Inc., Overland Park, Kans. $1,500 for three safety violations. The violations include failure to maintain driver qualification files for each driver employed, failure to require a driver to prepare a record of duty status report, and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection report.
  • Paque Installations Inc., Haysville, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Thompson Pump & Manufacturing Company Inc., Port Orange, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Duling Construction Co. Inc. d.b.a. Patrick Duling, Wichita, Kans. $2,250 for three safety violations. The violations include failure to maintain driver qualification files for each driver employed, for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection, and completing a trip without completing a driver vehicle inspection report.
  • TOKA Refuse LLC, Emporia, Kans. $1,500 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed and failure to maintain driver qualification files for each driver employed.
  • Industrial Electric Company d.b.a. Piping Technology Company, McPherson, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and for failure to maintain a current motor vehicle record for each driver employed.
  • Pro Services LLC, Haysville, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
  • Donald J. Wonser d.b.a. S & J Trucking, Leon, Kans. $1,000 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Rob Carroll’s Sandblasting and Painting d.b.a. Rob Carroll, Arkansas City, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Wes Brown d.b.a. Plum Cut, Wellsville, Kans. $2,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed, failure to maintain driver qualification files for each driver employed, and failure to require a driver to prepare a record of duty status report.
  • Furniture Delivery Services LLC, Lenexa, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Paul Eden d.b.a. Eden’s Auto Service Inc., Valley Center, Kans. $500 for failure to maintain driver qualification files for each driver employed.
  • Sales Midwest Inc., Olathe, Kans. $1,000 for failure to implement an alcohol and/or controlled substance testing program for each driver employed.
  • Central Kansas Rendering, Great Bend, Kans. $1,250 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Olathe Drywall Inc., Olathe, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
  • Johnson Transport Inc., Colby, Kans. $1,000 for allowing or requiring a driver to make false entries on his record of duty status report.
  • Larry Jones Trucking Inc., d.b.a. Larry Jones, Topeka, Kans. $2,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed, failure to require a driver to prepare a record of duty status report, and allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
  • G E Appliance d.b.a. B & K Installers, Merriam, Kans. $1,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver employed and for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Mike Dinkel d.b.a. Dinkel Truck Line, Penokee, Kans. $1,500 for three safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle more than 11 hours without being off duty 10 hours, to operate a commercial motor vehicle more than 14 hours without 10 hours off duty, and for allowing or requiring a driver to operate a commercial motor vehicle after being on duty 70 hours in a 8 day period.
  • E. Edwards Inc., d.b.a. E. Edwards Work Wear, Kansas City, Kans. $1,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver employed and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Gary M. Fagan d.b.a. Fagan Express, Hays, Kans. $1,000 for failure to implement a post accident alcohol and controlled substance test.
  • Mike Montey Trucking Inc., Salina, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
  • Conrady Western Inc., Anthony, Kans. $2,500 for four safety violations. The violations include failure to maintain driver qualification files for each driver employed, failure to maintain minimum records of vehicle inspection and maintenance, for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report, and to operate a commercial motor vehicle without a periodic inspection.
  • Vidricksen Distributing Co. Inc., Salina, Kans. $1,500 for four safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate, to complete a trip without completing a driver vehicle inspection report, to operate a commercial motor vehicle without a periodic inspection; and for failure to require a driver to prepare a record of duty status report.
  • Mike Solko Inc., Larned, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Risser Trucking LLC, Hope, Kans. $6,000 for two safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed and for allowing or requiring a driver to operate a commercial motor vehicle in interstate commerce without interstate for-hire operating authority.
  • H & T Trucking Inc., Emporia, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle after being on duty 70 hours in 8 days.
  • T. Orman’s Furniture and Flooring LLC, Overland Park, Kans. $2,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver employed and for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Terry and Stephanie Kinderknecht d.b.a. Kinderknecht Hay Almena, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle after 11 hours without taking 10 hours off duty and allowing, permitting, or requiring a driver to operate a commercial motor vehicle after 14 hours without 10 hours off duty.

The Transportation Division offers free compliance seminars. The seminars are held in Topeka, Hutchinson, Hays, and Garden City on a rotating schedule, beginning at 9:00 a.m. and lasting approximately two hours. These seminars are presented by the Commission’s Transportation staff and are designed to help motor carriers comply with safety and economic regulations. The KCC Transportation Division is responsible for regulating public and private motor carriers in Kansas. The Commission’s goal is to ensure appropriate and effective regulation and oversight of motor carriers and protect the public interest and safety.
