KCC assesses $52,000 in fines against 40 motor carriers

The Kansas Corporation Commission (KCC) assessed $52,000 in fines and penalties against 40 motor carriers for violations of Commission rules and regulations during the second-quarter of the state's fiscal year 2006 (Oct. 1 to Dec. 31, 2005). The violations were discovered during Safety Compliance Audits of 154 motor carriers, performed by the Commission's Transportation Division.

The Commission has fined the following motor carriers:

  • Crescent Limousine of Kansas d.b.a. Crescent Limo, Topeka, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle in interstate commerce without first obtaining operating authority.
  • Stein Inc. d.b.a. Ecowater Systems of Southwest Kansas, Dodge City, Kans. $500 for failure to maintain driver qualification files for each driver employed.
  • Agenda Kansas City Inc., Mission, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • APAC-Kansas Inc., Salina, Kans. $500 for failure to require a driver to prepare a record of duty status report.
  • John Weigel d.b.a. Sajon Trucking, Oberlin, Kans. $1,000 for failure to retain driver record of duty status reports and supporting documentation for a period of six-months.
  • Clay Troyer d.b.a. C & J Express, Pratt, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • King Construction Company Inc., Hesston, Kans. $3,000 for five safety violations. The violations include failure to register with the Pipeline and Hazardous Materials Safety Administration prior to transporting quantities of hazardous materials requiring posting of placards, allowing or requiring a driver to operate a commercial motor vehicle transporting hazardous material without first having documentation of hazardous material training and transporting hazardous material in an inappropriate storage container, failure to implement a hazardous materials security plan, and failure to require a driver to prepare a record of duty status report.
  • Pitt Trucking & Construction Inc., Belvue, Kans. $4,000 for three safety violations. The violations include failure to maintain minimum records of vehicle inspection and maintenance, and allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and operate a commercial motor vehicle without a periodic inspection.
  • Armour Amusement, Kansas City, Kans. $1,000 for failure to maintain driver qualification files for each driver employed.
  • Curtis Holmes d.b.a. K C Towing & Transport, Haysville, Kans. $3,000 for allowing or requiring a driver to make false entries on his record of duty status report.
  • Heartland Flatbed Transport LLC, Hays, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • B & B Delivery Enterprise LLC d.b.a. B & B Transfer, Lenexa, Kans. $1,000 for failure to implement a hazardous materials security plan prior to transporting hazardous material.
  • Circle R Operations LLC, Newton, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Curtis Machine Company Inc., Dodge City, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Margarito Neave d.b.a. Jasan Transport, Liberal, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle more then the allowed 11 hours without being off-duty 10 hours and allowing or requiring a driver to operate a commercial motor vehicle after 14 hours on-duty without being off-duty the required 10 hours.
  • Lavonne S. Wells & Richard D. Wells d.b.a. Wells Agri Enterprises, Viola, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Clyde E. McDonald d.b.a. McDonald Auto Sales & Salvage, Leonardville, Kans. $3,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed, failure to require a driver to prepare a record of duty status report, and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Cornejo & Sons Inc., Wichita, Kans. $6,000 for seven safety violations. The violations include failure to register with the Pipeline and Hazardous Materials Safety Administration prior to transporting quantities of hazardous materials requiring posting of placards, failure to prepare shipping papers describing the hazardous material being transported, failure to implement a hazardous materials security plan prior to transporting hazardous material, failure to implement an alcohol and/or controlled substance testing program for each driver employed, failure to maintain driver qualification files for each driver employed, for allowing or requiring a driver to make false entries on his record of duty status report, and for failure to require drivers to submit their record of duty status reports within thirteen days of completion.
  • H-D Oilfield Service Inc., Bazine, Kans. $2,500 for three safety violations. The violations include failure to maintain driver qualification files for each driver employed, and allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and operate a commercial motor vehicle without a periodic inspection.
  • Kansas Dirt Services LLC, Greensburg, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • Martin & Marjorie Webster, Coldwater, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • Mike Strong d.b.a. Mike's TV, Furniture & Appliance, Hutchinson, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • Sporer Land Development Inc., Oakley, Kans. $3,500 for three safety violations. The violations include allowing or requiring a driver not medically qualified and not having an intrastate waiver operate a commercial motor vehicle, failure to require a driver to prepare a record of duty status report, and for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Advanced Power Distributors, Sublette, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Golden Belt Feeders Inc., St. John, Kans. $2,500 for four safety violations. The violations include failure to maintain medical examiners certificate records, failure to maintain driver record of duty status reports and supporting documentation for a period of six-months, allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection and completing a trip without completing a driver vehicle inspection report.
  • Dan Hawes d.b.a. Mid America Recovery & Tow LLC, Leavenworth, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Duncan Brothers Trucking LLC, Ashland, Kans. $250 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • Horizon Systems Inc., Lawrence, Kans. $500 for failure to maintain a current motor vehicle record for each driver employed.
  • Full House Enterprises Inc., Colony, Kans. $2,000 for three safety violations. The violations include failure to maintain driver qualification files for each driver employed, allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection, and for failing to implement an alcohol and/or controlled substance testing program for each driver employed.
  • Midland Restoration Company Inc., Fort Scott, Kans. $3,000 for four safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program for each driver employed, failure to maintain driver qualification files for each driver employed, allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report and operate a commercial motor vehicle without a periodic inspection.
  • Riggs Irrigation LLC, Iuka, Kans. $1,500 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without operating authority and a valid medical examiners certificate.
  • Van Slyke Body Shop LLC, Pratt, Kans. $1,500 for two safety violations. The violations include failure to maintain driver qualification files for each driver employed and for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • John A. Marshall Company, Lenexa, Kans. $500 for allowing or requiring a driver to complete a trip without completing a driver vehicle inspection report.
  • Outpost Pictures, Lenexa, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • Bowens Service LLC, Atchison, Kans. $250 for allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate.
  • Chaffin Inc. d.b.a. SAC's Distributors, Dodge City, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without first having a valid medical examiners certificate and without a periodic inspection.
  • Deines Construction Inc., WaKeeney, Kans. $500 for failing to require a driver to prepare a record of duty status report.
  • Get a Move On Inc., Wichita, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
  • John Dunsworth d.b.a. JD's, Pratt, Kans. $500 for failing to maintain driver qualification files for each driver employed.
  • Resource Management Inc., Brownell, Kans. $1000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle more then the allowed 11 hours without being off-duty 10 hours and allowing or requiring a driver to operate a commercial motor vehicle after 14 hours on-duty without 10 hours off-duty.

The Transportation Division offers free compliance seminars. The seminars are held weekly on a rotating basis in Topeka, Hutchinson, Hays, and Garden City. The seminars, beginning at 9:00 a.m. and lasting approximately two hours, are presented by the Commission's Transportation staff and are designed to help Motor Carriers comply with Safety and Economic Regulations. The KCC Transportation Division is responsible for regulating public and private motor carriers in Kansas. The Commission's goal is to ensure appropriate and effective regulation and oversight of motor carriers and protect the public interest and safety.
