KCC assesses $69,700 in fines against 44 motor carriers
The Kansas Corporation Commission (KCC) assessed $69,700 in fines and penalties against 44 motor carriers for violations of Commission rules and regulations during the first-quarter of the state's fiscal year 2009 (July 1, 2008 to September 30, 2008). The violations were discovered during Safety Compliance Audits of 132 motor carriers, performed by the Commission's Transportation Division.
The KCC Transportation Division offers free compliance seminars. The seminars are held weekly on a rotating basis in Topeka, Hutchinson, Hays, and Garden City. The seminars, beginning at 9:00 a.m. and lasting approximately two hours, are presented by the Transportation Division's staff and are designed to help motor carriers comply with safety and economic regulations. The KCC Transportation Division is responsible for regulating public and private motor carriers in Kansas. The Commission's goal is to ensure appropriate and effective regulation and oversight of motor carriers and protect the public interest and safety.
The Commission has fined the following motor carriers:
- Action Tents Inc., Wichita, Kans., $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and failure to require drivers to prepare record of duty status reports.
- Andrew Moon d.b.a. A & M Towing and Recovery, Lawrence, Kans. $1,000 for allowing or requiring a driver to operate a commercial motor vehicle without proper operating authority.
- Bailey Truck Line Inc., Abilene, Kans. $9,000 for six safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain driver qualification files for each driver, failure to require drivers to prepare record of duty status reports, allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports, allowing or requiring a driver to operate a commercial motor vehicle after 14 hours on-duty without the required 10 hours off-duty, and allowing or requiring a driver to operate a commercial motor vehicle on and after the effective date of an out-of-service order.
- B & B Cooperative Ventures, Burlington, Kans. $1,000 for failure to maintain driver qualification files for each driver.
- Berry Companies Inc., Wichita, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.
- Bill Segebartt d.b.a. Segebartt Farms Hepler, Kans. $3,500 for five safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, allowing or requiring a driver to operate a commercial motor vehicle without proper operating authority, allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports, failure to maintain a current motor vehicle record for each driver, and allowing or requiring drivers to operate farm registered vehicles as common carriers.
- Bob Reed d.b.a. Reed Trucking, Galena, Kans. $500 for failure to require drivers to prepare record of duty status reports.
- Boyer-Kansas Inc. d.b.a. Shred-It, Overland Park, Kans. $3,500 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, allowing or requiring a driver with a positive alcohol and/or controlled substance test to operate a commercial motor vehicle without first being evaluated by a substance abuse professional, and allowing or requiring a driver to operate a commercial motor vehicle without proper operating authority.
- Classic Vending LLC, Emporia, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Central States Tile Inc., Overland Park, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Chuck Almon Trucking, Aurora, Kans. $500 for failure to require drivers to prepare record of duty status reports.
- Comtech Construction Systems LLC, Lawrence, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle more then the allowed 70 hours in a 8 consecutive day period.
- Daniel R. Morley, Belleville, Kans. $2,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain a current motor vehicle record for each driver, and failure to require drivers to submit record of duty status reports within 13 days.
- David E. Byers Trucking, Beattie, Kans. $1,500 for three safety violations. The violations include failure to require drivers to prepare record of duty status reports, allowing or requiring drivers to operate commercial motor vehicles transporting hazardous material without first having documentation on file of hazardous material training for each driver, and failure to maintain driver qualification files for each driver.
- Elvin Troutman d.b.a. Troutman Drywall Inc., Stilwell, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Frickey Investment Management Company LLC d.b.a. FIMCO Well Service, Norton, Kans. $2,000 for three safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without first obtaining a valid commercial drivers license, failure to require drivers to prepare record of duty status reports, and allowing or requiring drivers to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Fritzler Trucking Inc., Ness City, Kans. $1,500 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle after 14 hours on-duty without the required 10 hours off-duty and allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Fuels For Racing LLC, Canton, Kans. $3,500 for five safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports, allowing or requiring a driver to operate a commercial motor vehicle transporting hazardous material without documentation on file of hazardous material training for each driver, allowing or requiring a driver to operate a commercial motor vehicle transporting hazardous material without shipping papers identifying the hazardous material shipment, and allowing or requiring a drivers to make false entries in record of duty status reports.
- Gabriel Lopez d.b.a. Lopez Auto Repair and Sales, Emporia, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Glenn L. Fisher d.b.a. Fisher Trucking, Belleville, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Golden Valley Inc., Rozel, Kans. $5,000 for allowing or requiring an unqualified driver to operate a farm registered vehicle intrastate as a for-hire motor carrier.
- GUN-KO Traffic Control Inc., Olathe, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Jim's Tire & Auto Service Inc., Wichita, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Johnny W. Hunt d.b.a. Allied Towing Service, Olathe, Kans. $1,500 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Jose Contreras d.b.a. JLC Trucking, Holcomb, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Kent Hagerman, Timken, Kans. $2,000 for three safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain current motor vehicle records for each driver, and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Kindel Auto LLC d.b.a. Budreau Muffler Automotive & Tow, Pittsburg, Kans. $1,000 for two safety violations. The violations include failure to maintain a current motor vehicle record for each driver and allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Koss Construction Company, Topeka, Kans. $1,000 for two safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle after 14 hours on-duty without the required 10 hours off-duty and allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate.

- McNair Industries Inc. d.b.a. McNair Furniture Inc. d.b.a. Pittsburg Interiors, Pittsburg, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Michael J. Wimsett and Kenneth J. Wimsett d.b.a. W & W Production Company, Chanute, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Mid-America Drywall Supply Inc., Wichita, Kans. $2,000 for two safety violations. The violations include failure to maintain driver qualification files for each driver and failure to implement an alcohol and/or controlled substance testing program.
- Patrick H. Burton d.b.a. C & B Trucking, Independence, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Phelps Services LLC, Kingman, Kans. $2,500 for four safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain a current motor vehicle record for each driver, failure to require drivers to prepare a record of duty status report, and allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Precision Truss Inc., Marysville, Kans. $2,500 for four safety violations. The violations include failure to implement an alcohol and/or controlled substance testing program, failure to maintain a current motor vehicle record for each driver, failure to require drivers to prepare record of duty status reports, and allowing or requiring a driver to operate a commercial motor vehicle without completing driver vehicle inspection reports.
- Premier Freight Systems Inc., Emporia, Kans. $500 for allowing or requiring drivers to operate commercial motor vehicles without completing driver vehicle inspection reports.
- Robert C. Hull d.b.a. Bob's Mobile Home Service LLC, Ottawa, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Robert V. Price d.b.a. Price Trucking Company, Leonardville, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Roofing Services Unlimited Inc., Newton, Kans. $500 for allowing or requiring a driver to operate a commercial motor vehicle without a periodic inspection.
- Samuel J. Spillman d.b.a. Double-S Tree Service, Clay Center, Kans. $500 for failure to require drivers to prepare a record of duty status report.
- Shilling Construction Co. Inc., Manhattan, Kans. $7,200 for four safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without requiring the driver to submit to a follow-up drug test required by a substance abuse professional, failure to pay Unified Carrier Registration fees, failure to require drivers to prepare record of duty status reports, and failure to maintain driver qualification files for each driver.
- T J's Towing LLC, Gas, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Trucking by George Inc., Caney, Kans. $500 for failure to maintain a current motor vehicle record for each driver.
- Waste Connections of Kansas Inc., Wichita, Kans. $1,500 for three safety violations. The violations include allowing or requiring a driver to operate a commercial motor vehicle without a valid medical examiners certificate, allowing or requiring a medically unqualified driver to operate a commercial motor vehicle, and failure to require drivers to prepare record of duty status reports.
