Notice Regarding Confidential Designations
Per K.S.A. 66-1220a, information designated as CONFIDENTIAL must be a trade secret under the Uniform Trade Secrets Act (K.S.A. 60-3320 et seq., and amendments thereto) or confidential commercial information. An entity seeking to designate information as confidential must follow the requirements in K.A.R. 82-1-221a. Before filing an Annual Report (AR) or Annual Interrogatory (AI), please review the filing to ensure that publicly available data, including data otherwise available via the Kansas Secretary of State’s Office, is not designated as confidential in the filing. All filings containing confidential information shall contain:
- A written explanation stating why confidential designation is requested. Such explanation shall be specific to the section of the AR or AI, state whether the information is a trade secret or confidential commercial information, and specify the harm or potential harm disclosure would cause. This written explanation can be filed in pdf format electronically.
- If a filing includes confidential material, a public version must also be provided. The public version shall have the confidential portions removed in such a way that the lineation and pagination of the public version remains the same as the confidential version. This can be done by blacking out the numbers that are confidential, or writing the word redacted where the number should be.
- Each page containing confidential information should be marked CONFIDENTIAL at the top of the page.
If the filing is made electronically as a pdf, please ensure that all numbers are legible. An excel spreadsheet for Schedule 29 of the AR is preferred.
